District Plan committee

This page outlines the Terms of Reference, delegated authority and membership for the District Plan Committee (a committee of the Council).

Terms of Reference

The District Plan Committee shall have six primary functions, namely:

  1. Recommendations for initiating and overseeing the development of draft District Plans, draft District Plan Changes and/or draft Variations and draft Notices of Requirement initiated by Porirua City Council and determining the priority of such.
  2. Making of recommendations on any functions of a local authority under the Resource Management Act 1991 relating to all Designations and Heritage Orders.
  3. Making recommendations on any functions of a local authority under the Resource Management Act 1991 relating to processing all Private Plan Change Requests.
  4. Making recommendations to Council on approval of operative District Plans and Plan Changes.
  5. Appointing Hearings Panels to hear submissions on proposed district plans and proposed plan changes, and determining the makeup of such panels on an as-needed basis.
  6. Making recommendations on budget allocation for District Plan Review work.

Power to Act

Authority for the following Resource Management Act 1991 matters:

a. Implementation of any District Plan Change Review Programme(s) approved by the Council;
b. Approving discussion documents and Draft District Plan Changes and/or Variations for public feedback and comment;
c. Making recommendations to the Council on adopting Proposed District Plan Changes and/or Variations for public notification;
d. Making recommendations to the Council on Private Plan Change Requests;
e. Making recommendations to the Council on References and Appeals to decisions on Proposed Plan Changes, Requirements for Designations and Heritage Orders;
f. Making recommendations to the Council concerning all requirements to be notified by the Council, and all requirements received by the Council under Part 8 of the Resource Management Act 1991.
g. Appointing any Plan Change Hearings Subcommittees to hear submissions and make recommended decisions on Hearings of Proposed Plan Changes, Proposed Private Plan Changes and/or Variations;
h. Appointing one or more independent commissioners to sit on and/or chair such Plan Change Hearings Subcommittees.
